Le cadre juridique des brevets n'a en effet pas suivi le rythme du développement des produits numériques de pointe, qui peuvent souvent concerner des milliers de brevets. Et aujourd'hui, ce ne sont pas seulement les smartphones et les ordinateurs portables qui font appel à la technologie numérique, mais aussi nos voitures, nos thermostats, nos magasins etc. Le cadre juridique des brevets doit évoluer pour s’adapter efficacement à l'ère numérique afin de favoriser et préserver l'innovation.

In de motie van Tweede Kamerlid Amhaouch (CSA) wordt de regering verzocht te onderzoeken of het proportionaliteitsbeginsel voldoende verankerd is in het Nederlandse octrooirecht, en zo nee, te onderzoeken hoe dit beginsel verankerd kan worden. Het proportionaliteitsbeginsel houdt in dat een rechter bij de beoordeling meeweegt of een gevorderde maatregel (bijvoorbeeld een verbod) in verhouding staat tot de geconstateerde inbreuk op een octooi. In het rapport wordt geconcludeerd dat het proportionaliteitsbeginsel uit de Europese Handhavingsrichtlijn in relatie tot octrooi-inbreukverboden voldoende is vertaald in het Nederlandse octrooirecht.

In an opinion piece published in the French media Lex Daily News, IP2I calls on France to modernise its law so that the principle of proportionality is effectively applied especially given the growing presence of complex products. The French law needs to be modernised so that it is compatible with the EU’s Intellectual Property Rights Enforcement Directive (IPRED) and to ensure proportionality is effectively applied within the Unified Patent Court.

On 10 January, Christophe Blanchet MP submitted a written parliamentary question to the French Government, addressing the issue of proportionality in patent cases. On 16 May, the French Government's response was made public. Although the Government did not commit to a reform of the French legal framework in its answer, it is positive that there is increased public and political debate about proportionality.

De Kamer, gehoord de beraadslaging, constaterende dat het kabinet de Kamer heeft geïnformeerd over de uniformering van het Europese octrooiprocesrecht en dat de Rijksoctrooiwet gemoderniseerd wordt; constaterende dat in het Nederlandse octrooirecht geen expliciete proportionaliteitstoets is opgenomen, in tegenstelling tot de Europese handhavingsrichtlijn; overwegende het belang van een gebalanceerd octrooistelsel, waarbij aandacht is voor het belang van patenthouders én het belang van bedrijven die innovatieve producten op de markt brengen; verzoekt de regering te onderzoeken of het proportionaliteitsbeginsel in relatie tot (automatische) inbreukverboden uit de Europese handhavingsrichtlijn voldoende vertaald is in het Nederlandse octrooirecht en, zo nee, te onderzoeken hoe dit beginsel beter verankerd kan worden en dit onderzoek te laten uitvoeren door een gezaghebbende onafhankelijke partij, en gaat over tot de orde van de dag.

IP2Innovate, a coalition of technology-intensive companies and industry associations, read the Minister’s letter to your Committee with interest and is pleased to provide you with our views on how to improve the situation for the manufacturing industry based in the Netherlands. In particular, we believe that it is vitally important that a requirement that remedies in patent cases be proportionate, along with the key criteria for assessing proportionality, be added to the Dutch Patent Act.

BRIEF VAN DE MINISTER VAN ECONOMISCHE ZAKEN EN KLIMAAT Aan de Voorzitter van de Tweede Kamer der Staten-Generaal - Den Haag, 20 juni 2022 Tijdens het commissiedebat Innovatie van de vaste commissie voor Economische Zaken en Klimaat van 25 mei 2022 is door mij toegezegd uw Kamer nader te informeren over inbreukverboden en proportionaliteit in het octrooirecht.1 Met deze brief geef ik invulling aan deze toezegging.
