IP2Innovate statement on the European Commission’s plans to propose a new regulation governing SEP licensing

BRUSSELS, 5 April 2023 – According to news reports last week, the European Commission’s planned proposal for a Regulation on standard essential patents (SEPs) will tackle deep-rooted problems such as the lack of transparency and predictability in SEP licensing. IP2Innovate looks forward to reading the official proposal in the coming weeks.

 

The Commission appears to be serious about addressing some of the fault lines in Europe’s patents regime, and that is to be welcomed. The circulated proposal is a big step in the right direction. We look forward to working with the Commission and other stakeholders on any necessary changes.

 

IP2Innovate has been pushing for a more transparent, balanced patent system for many years. Some of the solutions we anticipate in the SEP regulation could pave the way for reforms to the broader patent regime. We hope this will be so.

IP2Innovate calls on the European Commission to strengthen EU law to ensure a balanced patent system and enhance Europe’s competitiveness

BRUSSELS, 25 March 2024 - IP2Innovate is calling for targeted amendments to EU intellectual property law to ensure that European patent courts consider the proportionality of remedies in their handling of patent litigation cases. The proposed amendments will help create a more balanced patent system. This will spur innovation and, in turn, help to address Europe’s lagging competitiveness. The 2004 EU IP Rights Enforcement Directive (IPRED) requires that remedies for patent infringement be applied in a proportionate manner, but courts are handing out injunctions to patent owners in effect automatically, without considering the disproportionate impact that may result.

IP2I welcomes the European Parliament's formal request, adopted today, calling on the Commission to investigate the practices of patent assertion entities in Europe.

Brussels, 11 November 2021 – The European Parliament has instructed the European Commission to investigate in-depth how PAEs, also known as non-practising entities, or more colloquially patent trolls, game the European patent system.

European courts failing over proportionality: IP2Innovate

Trade group IP2Innovate has warned that courts across Europe are failing to consider proportionality in patent cases, while urging the European Commission to promote similar reforms to those recently enacted in Germany.
