Tech and auto companies urge EU to crack down on patent trolls.

Tech and auto companies including Apple, BMW, Microsoft, and Samsung have urged the European Commission to take action to stop European courts from issuing automatic injunctions in favour of so-called ‘patent trolls’.

Brussels, 11 November 2021 – The European Parliament has instructed the European Commission to investigate in-depth how PAEs, also known as non-practising entities, or more colloquially patent trolls, game the European patent system.

Managing IP’s article outlining the views of Non-Practicing Entities (NPEs) on the Unified Patent Court (UPC) points out that several NPEs are gearing up for the launch of the UPC in the following months because the UPC’s centralised system “would make Europe a much easier place to litigate”. NPEs also argue that UPC would provide for another way to litigate in a “market comparable to China or the US”.
